Australia's High Court Blocks Coal Mine Expansion in Landmark Climate Ruling
First climate case to reach the nation's top court sets a “binding national precedent” — a ruling lawyers say will be studied internationally.
Australia's highest court on Wednesday rejected Mach Energy's appeal to extend the Mount Pleasant open-cut coal mine by more than 20 years, ruling the planning commission had failed to consider conditions limiting planet-heating emissions “to the greatest extent practicable.” The case was brought by two retired science teachers who fought the Hunter Valley expansion for years. “We cannot dig up coal, ship it overseas, watch it drive climate change, and then pretend the consequences have nothing to do with us,” said plaintiff Wendy Wales. Lead lawyer Anita O'Hart called it “historic.”
